Terms of Use

Agreement

These Terms of Use (the "Terms", and the end-user licence agreement for the app) are a contract between you and the developer of Momentum OS ("we", "us"). By downloading, installing or using Momentum OS you agree to them. If you do not agree, do not use the app.

Who can use Momentum

Momentum OS is for people aged 18 and over. By creating an account you confirm you are 18 or older. We do not knowingly provide the service to anyone under 18.

Your licence

We grant you a personal, non-transferable, non-exclusive licence to use Momentum OS on any Apple- or Android-branded device you own or control, as permitted by the usage rules of the store you obtained it from. You may not sell, rent, sublicense, redistribute, reverse-engineer or attempt to extract the source code of the app, except where that restriction is prohibited by law.

Subscriptions

Momentum OS is free to download. Some features require an auto-renewing subscription, purchased through the App Store or Google Play. The plans offered are:

• Momentum Pro — Monthly. Length: 1 month. Renews monthly.
• Momentum Pro — Annual. Length: 1 year. Renews yearly.
• Momentum Elite — Monthly. Length: 1 month. Renews monthly. Includes Pro plus the AI Coach and Labs & Longevity add-ons.
• Momentum Elite — Annual. Length: 1 year. Renews yearly. Includes Pro plus the AI Coach and Labs & Longevity add-ons.
• AI Coach. Length: 1 month. Renews monthly. A standalone add-on.
• Labs & Longevity. Length: 1 month. Renews monthly. A standalone add-on.
• Momentum Family, where offered. Length: 1 month or 1 year. Covers the subscriber plus up to five family members.

Price. The price of each plan is shown in the app on the subscription screen, in your local currency, before you confirm any purchase, and again by the App Store or Google Play at the moment of purchase. Prices vary by territory and may change; a price change never applies to a period you have already paid for, and where the store requires it we will seek your consent before a renewal at a new price.

Free trial. Momentum Pro plans may be offered with a 7-day free trial. A payment method is taken at sign-up and the subscription converts to a paid term automatically at the end of the trial unless you cancel at least 24 hours before it ends. Elite plans and the add-ons are not offered with a trial. If you subscribe while an unused portion of a free trial remains, that unused portion is forfeited.

Auto-renewal. Payment is charged to your Apple ID or Google account at confirmation of purchase. Subscriptions renew automatically for the same length and at the same price unless auto-renewal is turned off at least 24 hours before the end of the current period. The renewal charge is taken within 24 hours before the end of the current period.

Cancelling. You can manage or cancel a subscription at any time in your account settings: on iOS, Settings → your name → Subscriptions; on Android, the Google Play app → Payments & subscriptions → Subscriptions. Cancelling stops the next renewal — access continues until the end of the period you have paid for. Deleting the app does not cancel a subscription. We cannot cancel a store subscription on your behalf.

One-off in-app purchases

Streak freeze packs are consumable purchases. A freeze is spent when it protects a missed day; spent freezes are gone and are not restored.

Gift subscriptions fund a prize for another person in a challenge you host. The buyer receives no subscription and no other benefit from the purchase. If the challenge settles with a qualifying winner, the winner receives the gifted months as a promotional grant; if nobody qualifies, the grant returns to the host's own account, as stated at checkout. No money passes between users and there is no way to cash a purchase out.

Refunds

All purchases are handled by the App Store or Google Play, and refunds are theirs to give under their policies — we cannot issue one directly. Apple: reportaproblem.apple.com. Google: Play order history. Where consumer law in your country gives you a stronger right, that law applies.

Your account

You are responsible for what happens under your account and for keeping access to your email secure, since sign-in uses one-time codes sent there. Tell us promptly if you believe someone else is using your account. You can delete your account and all synced data at any time in Settings → Account → Delete account, or from the account deletion page.

Community content and zero tolerance

Momentum lets you post content — display names, profile photos, recipes, challenge and group names, and messages — and to interact with other people. You keep ownership of what you post, and you grant us the licence needed to store it and show it to the people you share it with.

There is zero tolerance for objectionable content or abusive behaviour. You may not post anything that is unlawful, hateful, harassing, threatening, sexually explicit, violent, defamatory, spam, or that impersonates another person or infringes anyone's rights. You may not use the app to harass, stalk or endanger anyone.

Every place you can post content, you can also report it and block the person who posted it. We review reports and act on them — removing content, and suspending or permanently terminating the accounts of users who breach this section — within 24 hours of a report. We may remove content or suspend an account at any time, with or without notice, when we believe this section has been breached.

Health and fitness — not medical advice

Momentum OS is a fitness and nutrition tracking tool. Everything it shows you — training plans, calorie and macro targets, body-composition estimates, supplement information, bloodwork commentary and any coaching text — is general information, not medical advice, and is not a diagnosis, treatment, or a substitute for a qualified professional.

Talk to a doctor before starting a training or nutrition programme, especially if you are pregnant, have a medical condition, or take medication. Never disregard professional advice or delay seeking it because of something you read in this app. Stop exercising and seek help if you feel unwell. You train at your own risk.

AI features

Some features use AI models to generate text and to interpret photos you choose to submit. AI output can be wrong, incomplete, or confidently mistaken — nutrition estimates from a photo especially so. Treat it as a starting point and check anything that matters. Do not rely on AI output for medical, safety or financial decisions.

Acceptable use

Do not attempt to break, overload, probe or circumvent the app or its servers; do not use it to build a competing dataset or service; do not falsify challenge, leaderboard or streak data; and do not use it in any way that breaks the law where you are.

Our content

The app, its design, its exercise and recipe libraries, and everything else we supply remain ours or our licensors'. Nothing in these Terms transfers ownership of it to you.

Termination

You may stop using Momentum OS at any time and delete your account from Settings. We may suspend or terminate your access if you breach these Terms — immediately in the case of the community-content section. Termination does not entitle you to a refund of a period already paid for, except where the law or the store's policy says otherwise.

Disclaimers and liability

Momentum OS is provided "as is" and "as available", without warranties of any kind to the fullest extent the law allows. We do not warrant that it will be uninterrupted, error-free, or that any particular result will be achieved. To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, or for lost data or lost profits, and our total liability for any claim relating to the app is limited to the amount you paid us for it in the twelve months before the claim. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence.

Your data lives primarily on your own device. Keeping your own backups is your responsibility; the cloud backup is a convenience, not a guarantee.

Privacy

How we handle your data is described in the Privacy Policy, which forms part of these Terms.

If you obtained the app from the Apple App Store

These Terms are between you and us only, not with Apple, and we alone are responsible for Momentum OS and its content. Apple has no obligation to provide any maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. We, not Apple, are responsible for addressing any claim by you or a third party relating to the app — including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation — and for investigating, defending and settling any claim that the app infringes a third party's intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties. You must comply with any applicable third-party terms of agreement when using the app. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you as a third-party beneficiary.

Changes to these Terms

We may update these Terms as the app changes. The effective date at the top will change, and material changes will be surfaced in the app. Continuing to use Momentum OS after an update means you accept the revised Terms.

Governing law

These Terms are governed by the laws of the United States and of the state in which we are established, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence are unaffected.
